Birth Injury, Shoulder Dystocia – Sample Case
Akron & Canton, Ohio

The lawsuit:

Woman files a lawsuit against her ob/gyn for failing to deliver her baby properly, resulting in a broken collarbone, left arm paralysis and Erb’s palsy.

What happened:

Woman gives birth to her daughter at a local hospital. When her daughter was born she was found to have a broken collarbone and her left arm was paralyzed. The infant was found to have Erb’s Palsy, which is when the nerves in the shoulder are damaged. This was caused by shoulder dystocia, which existed at the time of birth. A lawsuit was filed against the ob/gyn and the case went to trial. It was proven at trial that the doctor did not properly deliver the baby and a c-section should have been performed.

The jury returned a verdict in the amount of 1 million dollars.

If you believe your child’s birth injury resulted in Erb’s palsy or some other condition, you may have a claim. Be sure to consult a birth injury attorney immediately to investigate the matter, as there are strict time limitations for pursuing these types of cases.
