What happened:
Woman gives birth to her daughter at a local hospital. When her daughter was born she was found to have a broken collarbone and her left arm was paralyzed. The infant was found to have Erb’s Palsy, which is when the nerves in the shoulder are damaged. This was caused by shoulder dystocia, which existed at the time of birth. A lawsuit was filed against the ob/gyn and the case went to trial. It was proven at trial that the doctor did not properly deliver the baby and a c-section should have been performed.
The jury returned a verdict in the amount of 1 million dollars.
